Terms of use

This Agreement is a public contract - an offer (proposal) of a legal entity - LIMITED LIABILITY COMPANY "TILKY TAK RECORDS" (hereinafter referred to as "Seller") with an individual (who has legal capacity) or a legal entity (hereinafter referred to as "Buyer"), which includes all essential conditions for organizing distance selling (i.e., through an online store). Relations in the field of consumer protection are regulated by the Civil Code of Ukraine, the Law "On Consumer Protection" and other laws and legal acts of Ukraine adopted in accordance with it.

1. Terms and Definitions

1.2. Seller - LLC "TILKY TAK RECORDS" (Legal address: 29000, Khmelnytskyi, st. Druha Nova, 69, EDRPOU code 45451424, Tax Identification Number (TIN)  454514222254, IBAN: UA593395002600601592223000001, (VAT payer, general taxation system) tel.: +380976389430, email: tt.records.ua@gmail.com 

1.3. Buyer - any individual or legal entity that has accepted the Seller's public offer.

1.4. Online store - the official online store of the Seller "TilkytakRecords", located at https://tilkytakrecords.ua. Within the framework of this agreement, the concepts of Online store and Store are equivalent and are interpreted authentically in the context of the offer.

1.5. Distance trading - a form of selling goods outside trading or office premises, in which the buyer's choice of goods and their ordering from the seller in this way is carried out by the buyer personally or by the consumer of the goods.

1.6. Distance communication means - telecommunication networks, postal communication, television, information networks, including the Internet, which can be used for concluding contracts at a distance.

1.7. Agreement - an oral or written transaction between a consumer and a seller regarding quality, terms, price and other conditions under which products are sold. Confirmation of entering into a transaction in the context of this agreement is a receipt, commodity or cash receipt, ticket, coupon or other documents (hereinafter - settlement document).

1.8. Distance contract - a contract concluded by the seller with the consumer using distance communication means.

1.9. Sale of goods on order - a type of trade in which the consumer concludes a purchase and sale agreement with the seller at a distance using distance communication means or makes their preliminary order directly from the seller.

2. Subject of the Agreement

2.1. The Seller undertakes to transfer ownership of the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods under the terms of this Agreement.

2.2. The date of concluding the Offer Agreement (acceptance of the offer) and the moment of complete and unconditional acceptance by the Buyer of the Agreement terms is considered to be the submission of an electronic request to order Goods or placing the selected Goods in the Shopping Cart.

3. Moment of Contract Conclusion

3.1. The text of this Agreement is a public offer (in accordance with part 2 of Article 633 and Article 641 of the Civil Code of Ukraine).

3.2. Acceptance of this offer (agreement) - the Buyer's placing an order for Goods in accordance with the terms of this offer. The Buyer irrevocably accepts all conditions contained in the offer as a whole (i.e., in full and without exceptions).

3.3. The Buyer's placing an order for Goods is done by performing the actions specified in the "Payment and Delivery" section.

3.4. The agreement concluded on the basis of the Buyer's acceptance of this offer is an adhesion contract to which the Buyer joins without any exceptions or reservations.

3.5. The fact of the Buyer placing an order is an indisputable fact of the Buyer's acceptance of the terms of this Agreement, including the Buyer's consent to receive SMS messages from the Seller, as well as emails about their order and other communications to improve service quality. Acceptance of goods in the Seller's online store is considered confirmation of the contract conclusion.

3.6. The Buyer independently places an order in the Online store through the "shopping cart form" or submits a request by phone/email. In the cart form, the Buyer specifies full name, email address, contact phone number, and other information.

3.7. After placing an order through the "shopping cart form," the Seller must process the order within 24 hours (on business days): reserve the Goods in the store, arrange its shipment to a delivery service branch, or notify the Buyer of the inability to fulfill the order. If an order is placed on a weekend or holiday, the processing period will start from the first business day.

After placing an order through the "shopping cart form," if the Buyer indicates the need for order confirmation, the Seller must confirm by phone within 24 hours the availability of the selected Goods, price, agree on delivery terms, or notify about the inability to fulfill the order due to unavailability of Goods.
